Moet ik een testament maken?

“Maar ik hoef toch geen testament meer te maken, alles is nu toch al automatisch via de wet geregeld?”, wordt mij regelmatig gevraagd.

“Nou dat valt eigenlijk toch wel tegen” menen de meeste mensen wanneer ik ze uitleg hoe dat nu precies zit.

Want wanneer u overlijdt en een echtgenoot en tenminste 1 kind achterlaat, geldt weliswaar automatisch de wettelijke verdeling die lijkt op het langstlevende testament, maar er zijn toch wel een paar heel belangrijke verschillen.

Zo geldt bijvoorbeeld niet de anti schoonzoon- of schoondochter clausule, die voorkomt dat wat uw kind van u erft, gedeeld moet worden met een ex. Eigenlijk is dit al voldoende reden voor de meeste mensen om direct een testament te maken.

Maar er is nog meer. Want stel dat u na het overlijden van uw echtgenoot wilt hertrouwen. Dan kunnen uw kinderen zich beroepen op hun wilsrechten. Die wilsrechten moeten het zogenaamde stiefouder gevaar voorkomen. Uw kinderen kunnen dan alvast goederen opeisen ter waarde van hun erfdeel om te voorkomen dat het hele vermogen naar een stiefouder vererft. U krijgt nog wel het vruchtgebruik van deze goederen.

Maar zeg nu zelf, die wettelijke verdeling moet toch een langstlevende regeling zijn? Maar u als langstlevende wordt zo door uw kinderen beperkt. Nóg een reden om een testament te maken, want dan kunt u die wilsrechten namelijk helemaal uitsluiten.

En met een testament kunt u uw vermogen ook beschermen tegen de AWBZ regeling.

Tot slot kan er altijd op de erfbelasting worden bespaard door het maken van een testament. Daarin kunnen namelijk een aantal “fiscale instrumenten” worden opgenomen, die ervoor zorgen dat de erfbelasting zo laag mogelijk is. Ik reken het graag voor u uit!
